The Active Planning Applications List shows permits for land use entitlements – also referred to as development or zoning permits – that are currently under review. These are primarily discretionary permits that require a public hearing and are acted on by the Planning Commission and/or City Council. Planning applications are reviewed by staff for consistency with local and state planning and zoning laws, including the Zoning Ordinance, General Plan, Local Coastal Land Use Plan and California Environmental Quality Act (CEQA), and are then referred to the applicable decision-making body for action.

There are some exceptions to the discretionary requirements under state law which require ministerial review, meaning that the City must approve the project if it meets certain objective criteria. These include, but are not limited to, the following: 

  • Senate Bill (SB) 9 for up to four dwelling units and urban lot splits on single-family zoned lots; CEQA does not apply
  • SB 35 / SB 423 for affordable housing projects that meet prevailing wages and other requirements; CEQA does not apply
  • Builder’s Remedy for housing development projects in jurisdictions that do not have a Housing Element that is in substantial compliance with State law and that meet certain affordability requirements; subject to the applicable environmental review under CEQA

Under the Housing Crisis Act of 2019, or SB 330, any housing development project may vest to zoning and planning laws at the time a complete preliminary application is filed and are subject to five-hearing limit. Applications under SB 330 may require discretionary permits and environmental review, depending on the project and location, however, SB 330 also applies to the non-discretionary projects listed above.  

The City process all planning applications in accordance with state law. The Active Planning Application List provides the project file number for reference, address or location, project name and description, status, contact, and assigned staff. Once a project receives a planning approval and the applicable appeal period has lapsed, it is removed from the list. teal green pin Approved Recently approved planning projects/applications (since last update)
light yellow pin  Completeness Review Once a  planning application is submitted, the City has 30 days to determine if the application is complete or incomplete. Completeness review must be based on the agency's published submittal requirements. Staff must determine whether the application is complete or incomplete within 30 days of resubmittal.

 

For projects that filed an SB 330 Preliminary Application, the regular planning application must be submitted within 180 days of the submittal of a preliminary application to retain vesting. If the application is deemed incomplete, the applicant must resubmit the application within 90 days of receiving a notice incomplete notice to maintain the validity of the preliminary application.  
orange pin CEQA Review After a determination of completeness, the City must determine how to proceed under the California Environmental Quality Act (CEQA). Projects may be exempt from CEQA, require an Initial Study, or require an Environmental Impact Report (EIR). 
light green pin Consistency Review Within 30 or 60 days, depending on project size, of the City’s determination of completeness, the City must provide a letter noting all project inconsistencies with state and local law and regulations.
